Alternative Dispute Resolution (ADR) involves any method, other than litigation for seeking agreement over disputed matters. It includes adjudication, arbitration & conciliation. Robert Forrester recently returned from Berlin, where he examined emerging methods of conflict management and resolution, working with members of UN Development Program, UN Mission for Iraq, German Foreign Office, Swedish Chamber of Commerce and various international NGOs.
Key ‘take home’ messages were that carefully considered and clearly drafted agreements prevail almost without exception. Continuing consensual relationships, if at all possible, rather than ‘top-down’ arbitration, ensures that parties remain in control of their solutions, achieving better win-win outcomes.
